Please read these Terms of Service ("Terms") carefully before using the FairValue Tax Appeal website or services. These Terms are a legal agreement between you and PLAINVIEW REIT, LLC d/b/a FairValue Tax Appeal. By accessing the Site or submitting an authorization form, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. About FairValue Tax Appeal

PLAINVIEW REIT, LLC d/b/a FairValue Tax Appeal ("FairValue," "we," "us," or "our") is a property tax grievance filing service operating in New York State. FairValue Tax Appeal is not a licensed law firm and does not provide legal advice. Our services consist of preparing and filing property tax grievance applications with the Nassau County Assessment Review Commission (ARC) and, where applicable, representing clients in Small Claims Assessment Review (SCAR) proceedings before the New York State Supreme Court as a non-attorney representative.

You are not required by law to hire a tax reduction company to file a grievance. You may file on your own at no cost through Nassau County's ARC portal.

2. Eligibility

To use our services, you must:

  • Be at least 18 years of age.
  • Be the recorded owner of the property.
  • Own a one-, two-, or three-family home used exclusively for residential purposes (unless otherwise agreed in writing).
  • Be filing for a Nassau County property (Suffolk County availability subject to separate agreement).

3. Service Agreement & Authorization

By submitting the digital authorization form you authorize FairValue Tax Appeal to:

  • Prepare and file your tax grievance application with the Nassau County ARC for the 2027/28 tax year.
  • Represent you in ARC communications, settlement negotiations, and SCAR proceedings as needed.
  • Accept ARC settlement offers on your behalf at our discretion.
  • Receive any property tax refund check issued by Nassau County, deduct our fee, and remit the balance to you within 30 days.

Your authorization is exclusive — you may only hire one representative per property per tax year. By executing an authorization with FairValue you agree not to retain any other representative or attorney for the same filing period.

4. Fees & Payment

We offer two fee arrangements, selected at checkout:

4a. Contingency Plan (No Win, No Fee)

  • No fee is charged if there is no assessment reduction.
  • If successful, you agree to pay 30% of your tax savings for the 2027/28 tax year, calculated using 2027/28 tax rates only.
  • If a SCAR appeal is filed and warranted, you agree to pay or reimburse the $30 NYS Court filing fee.
  • If you default on payment after 30 days, the fee increases to 50% of savings plus a $50 late fee, plus any reasonable attorney's fees and court costs incurred by FairValue in collection.
  • You remain responsible for the fee if you sell your home or vacate the property. It is your responsibility to notify FairValue of a pending sale so the case may be transferred to the buyer prior to closing.
  • By saving your payment method at checkout, you authorize FairValue to charge the card on file upon resolution of your appeal.

4b. Flat Fee Plan

  • A one-time fee of $149.00 is charged at the time of filing.
  • This fee is non-refundable once your case has been submitted to the ARC.
  • You keep 100% of any tax savings achieved.
  • The SCAR filing fee ($30) applies if a SCAR appeal is warranted and filed.

All payments are processed securely by Stripe, Inc. We do not store card numbers on our servers.

5. Cancellation Policy

You may cancel by written request, with no penalty, before your case is filed with the Nassau County ARC (filing deadline: March 31, 2026 for the 2027/28 cycle).

Contingency plan: Cases withdrawn after filing, or withdrawn due to a duplicate filing, are subject to a $285 cancellation fee.

Flat fee plan: The $149 fee is non-refundable once your case has been filed with ARC.

To cancel, email cancel@fairvaluetaxappeals.com with your name, property address, and reason for cancellation.

6. No Guarantee of Results

FairValue Tax Appeal makes no guarantee that your assessment will be reduced. Results depend on applicable law, comparable sales evidence, ARC decisions, and SCAR court rulings, all of which are outside our control. Past results for other clients do not guarantee similar outcomes for you.

7. Electronic Signature & Records

By typing your name and signing the digital authorization form, you agree that your electronic signature has the same legal effect as a handwritten signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN) and New York Electronic Signatures and Records Act (ESRA).

You consent to receive all disclosures, agreements, and communications electronically. You may request a paper copy at any time by contacting us.

8. Intellectual Property

All content on the Site — including text, graphics, logos, and software — is owned by or licensed to FairValue Tax Appeal and protected by U.S. copyright and trademark law. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FAIRVALUE TAX APPEAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless FairValue Tax Appeal and its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from your violation of these Terms or misrepresentation of your eligibility to file a grievance.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services shall be resolved exclusively in the state or federal courts located in Nassau County, New York, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms at any time. We will post the updated Terms on this page with a revised "Last updated" date. Material changes will be communicated by email or a prominent Site notice. Your continued use of the services after changes take effect constitutes acceptance of the new Terms.
